on this feedback, the WUC has decided to
move forward with preparing a bill and find
Congressional sponsors from both sides of
the aisle. Then, next year’s Fly-In will hopefully
be targeting finding Representatives
who will sign on as co-sponsors.
Chemical security remains an issue for
water utilities. HR 2856 was passed last
year, allowing for continued water industry
exemption from CFATS (the Chemical
Facility Security and Anti-Terrorism
Standards). It did, however, provide for a
new facility security program that will be
overseen by EPA and not the Department
of Homeland Security. It also requires
community water systems to revise their
vulnerability assessment every five years
and, in some cases, may require utilities to
consider Inherently Safer Technology (IST).
This could mandate that utilities using
chlorine gas change to alternative disinfectants.
This is a sore point with AWWA.
On the Senate side, S 2996 was introduced
in February 2010 and reauthorizes CFATS
John Morris with Representative
Adam Schiff (D-29th District)
for five years and maintains the exemption
for water and wastewater. The message
that the delegation gave to Representatives
was that when the S 2996 is passed and
these two bills get reconciled in conference
committee, AWWA would appreciate
Congress “just say no to IST.”
The CA-NV Section’s last comment
to each Representative and Senator
was that the Section stands by to be a
resource to Congress for information
on water and to please call us so we
can access the best experts from our
membership to advise them as best we
can on important water issues. S
